Counsel is asked to advise on the rights of the

Company, in particular whether it may sell water, and

on the position of the Government with regard to the

pipe line permit, in particular as to whether power

exists to refuse renewal of the permit, unconditionally

or otherwise, e.g. subject to a condition de barring sale.

Counsel will please contemplate the possibility that

the sugar Refinery Lot and Inland Lot No. 1336 may rea-

pectively pass into different ownership, and advise

whether the Government is under any and if so what

obligation to allow a pipe line or water-duct to remain

or be repositioned to meet the varying requirements for

the time being and from time to time of any owner of

the reservoir.

Copies of the Conditions of Sale, Crown Lease,

Supplemental Deed and Permit, and of the correspondence,

are attached.
